The Privacy Notice is in compliance with the Personal Information Protection and Electronics Documentation Act (PIPEDA) and the CSA Model Code for the Protection of Personal Information.

The following are BFSA’s governing Privacy Notice principles:

  • Accountability – we are accountable for any personal information we receive and also that we may disclose to our Third Party Service Providers. The Data Protection Office is a member of our management team and their responsibilities include compliance with privacy governance, dispute resolution, education and communication activities.

  • Identifying the purpose of collecting personal information – reasons for the collection of personal information include:

    i) respond to queries or requests submitted by you
    ii) anticipate and resolve problems with any products or services supplied to you
    iii) better tailor and improve the features of products and services
    iv) create products or services that may meet your needs
    v) to communicate with financial institutions and Third Party Service Providers
    vi) to offer additional financial products that may benefit you
    vii) to provide ongoing services
    viii) to comply with federal and provincial legal and regulatory requirements

  • Obtaining consent – we obtain your express or implied consent when you visit the Website and before or when we collect, use or disclose your personal information, except where permitted or required by applicable laws.

  • Limit the collection of personal information – the collection of personal information is limited to that which is required by law or for our identified purposes.

  • Limit the use, disclosure and retention of personal information – we will only use or disclose your personal information for the reason(s) it was collected, unless you provide BFSA with consent to use or disclose for another reason or unless we have a regulatory duty or right to disclose personal information without consent.

    We may disclose your Personal Information on a need to know basis to Third Party Service Providers that provide services on our behalf,  which information may include your name, address, banking information and/or social insurance number. We will only provide those companies the information they need to deliver their respective service and they are prohibited from using that information for any other purpose. We may disclose your Personal Information in the context of certain business transactions, such as the purchase, sale, lease, merger, amalgamation or any other type of acquisition, disposal, securitization or financing involving BFSA. Finally, we may also disclose your Personal Information where otherwise required or authorized by law.

    We will keep your personal information only for as long as it fulfills its intended purpose or as legally required. Moreover, as explained in the Opt out/modify information section, you may request that we remove your personal information from our records so you will not receive future communications from us.

  • Keep personal information accurate – we are committed to keeping your personal information as accurate and as complete as possible. Please notify us immediately if your personal information changes so that our systems can be updated. We will update personal information only if it is necessary for the purpose for which it was originally collected. Please see Response to concerns to address any issues regarding the accuracy or completeness of your personal information.

  • Use appropriate safeguards – we have secure systems and controls in place to safeguard your personal information and protect our systems. Examples include limiting the access of personal information to employees or Third Party Service Providers on a “need to know” basis and only when they have been authorized to access the information. We ensure any Third Party Service Provider has executed an agreement with us that governs the use of any personal information that they may obtain from us.

  • Transparency – we are open as to how we manage your personal information. Our Privacy Notice outlines why we ask for your personal information and who we may share or disclose it with. Please see Response to concerns should you need to report a concern.

  • Individual access – should you wish to review or verify your personal information that we have in our possession or to find out what it has been used for or whom it has been disclosed to, please contact us at [email protected]. There will be no charge for us to provide this information. There may be instances when we are unable to provide you with some of the information we hold about you, in which case, we will let you know the reasons why. We will need to authenticate the identity of the requestor, for example by copy of a driver’s license.

  • Opt out/modify information - by contacting [email protected], you may remove your personal information so you will not receive future communications, or you may modify your personal information that we have previously gathered. We will update personal information only if it is necessary for the purpose for which it was originally collected (and or direct you to the appropriate party to provide such updates). Please see Response to concerns to address any issues regarding the accuracy or completeness of your personal information.

  • Response to concerns - to the extent, a perceived violation or issue of non compliance has been found, it should be immediately addressed to the Data Protection Office at [email protected]. BFSA will log the issue, notify internal personnel and if necessary, report to the appropriate Provincial Consumer Services branch (i.e. Ministry of Consumer Services – Consumer Protection Branch). BFSA will address such issue with utmost confidentiality and urgency.

Security Policy

Please read this Security Policy carefully. It describes how BFSA and the Website safeguard your personal data.

Security 
We rely on a third party network administrator to host the Website and guard against external threats through the use of up-to-date technologies such as firewalls, anti-virus, spam and similar technologies. We have our network proactively monitored for capacity, unauthorized penetration and similar threats on a periodic basis.

Browsers
The Website is compatible with all leading browsers, including Internet Explorer, Firefox, Safari and Chrome. We will monitor market developments and will ensure that this remains the case, within a reasonable time of new developments.

Third Party Network Administrator
Through a Third Party Network Administrator, the security of our website goes through the following steps to ensure the security of our website and your personal information.

  • Before entering the Third Party Network, all traffic is filtered through 3 blacklists. Specifically, the SpamHaus DROP list (https://www.spamhaus.org/drop/), the OpenBL base list (https://www.openbl.org/lists/base.txt), and the DShield Recommended Drop list. These lists are gathered by these 3 organizations on a live basis from all over the world. The lists consist of internet hosts (IP's) that have been found to generate malicious connections. This usually comes from hack attempts or other malicious traffic. The Third Party Network Administrator updates these lists every evening.

  • The Third Party Network Administrator has their own configuration. They have allocated some trap IP addresses that are not currently in use on their network. If there are any attempted connections to these IP's, the originator is added to a list and filtered out before entering our network. Potential culprits are removed from this filter after 14 days.

  • Only specific traffic is allowed to their hosting platform (ie. web, email, etc.). Any extraneous traffic could be malicious, and is immediately filtered.

  • Their cPanel-based hosting platform is automatically updated on a regular basis. Both the Operating System and the cPanel components are updated with the latest security and critical fixes on a nightly basis. This ensures that the platform has the smallest possible hacking footprint.

  • They also use a prevention mechanism to counteract a brute force attack that locks out any IP address that is attempting to log into the site multiple times within a short period of time with incorrect credentials.

  • In addition to the prevention mechanism, they run a third-party application that provides an extra layer within cPanel that catches additional log in attempts that prevention mechanism does not. It also monitors application usage on the server and alerts on anything out of the ordinary/outside the baseline. These are then investigated as required.

  • They do site-level backups twice per week. These are kept for a month. In the event data is lost or otherwise inaccessible, they are able to restore sites on an as-needed basis.

  • Finally, they replicate the entire hosting platform to another server within their datacenter. In the event of hardware failure, we are able to fail over to a second server in relatively short order.


Spoofing and phishing
If you are suspicious of the URL or the site does not resemble BeaconFSA.com, log off immediately and report the matter to [email protected].

Cookies 
The Website uses session cookies to manage your interactive session. A cookie is an identification tag that our server gives to your Web browser when on the Website. When you shut down your browser, that ID is deleted. No personal information is stored in a permanent cookie on your computer once the session is complete.

Applicable Law
The Website is administered by Beacon FSA Inc. from Burlington, Ontario, Canada and is hosted by a Third Party Network Administrator. You submit and attorn to the non-exclusive jurisdiction of the courts of the Province of Ontario to finally adjudicate or determine any suit, action or proceeding arising out of or in connection with the Website and/or these Terms of Use. You may not assign any rights under the Terms of Use and any purported assignment will be ineffective.
